Una joven mujer de una comunidad del oriente de Yucat\u00e1n que fue madre a edad temprana obtuvo un ajuste equitativo en el reparto de la carga alimentaria y en el r\u00e9gimen de cuidados de su hijo decretado en el juicio familiar, luego de que la Sala Colegiada Civil y Familiar del Tribunal Superior de Justicia del Estado revisara su caso y considerara que la situaci\u00f3n la colocaba en posici\u00f3n de desventaja y contribu\u00eda profundizar la desigualdad en las oportunidades de desarrollo.<\/p>\n

Bajo una perspectiva de g\u00e9nero y a partir de un enfoque interseccional, los integrantes de dicha Sala, magistradas Leticia del Socorro Cob\u00e1 Maga\u00f1a, Sary \u00c1vila Novelo, Graciela Torres Garma, as\u00ed como los magistrados Alberto Salum Ventre, quien preside este cuerpo colegiado, y Jos\u00e9 Pablo Abreu Sacramento, analizaron el caso y se\u00f1alaron que la distribuci\u00f3n inicial de las responsabilidades parentales era desproporcionada.<\/p>\n

Esta situaci\u00f3n, mencionaron, colocaba a la madre del ni\u00f1o involucrado en una situaci\u00f3n de desventaja, pues no se valoraron integralmente las aportaciones de aquella, ni el contexto de vulnerabilidad y desequilibrio en que se encontraba al haber sido madre en la adolescencia.<\/p>\n

\"Justicia<\/p>\n

Equidad para madres adolescentes<\/strong><\/h4>\n

Al resolver el asunto, las y los magistrados determinaron por unanimidad hacer un ajuste equitativo en el reparto de la carga alimentaria, as\u00ed como en el r\u00e9gimen de cuidados decretado en el juicio familiar, con el objetivo de reconocer las brechas de oportunidad que enfrentan las mujeres que fueron madres a edad temprana.<\/p>\n

De esta forma, se decidi\u00f3 aumentar la pensi\u00f3n alimenticia a cargo del padre, sin perder de vista las posibilidades reales de \u00e9ste, y se modific\u00f3 el r\u00e9gimen de convivencia, para efectos de que, en caso de que el padre se viera impedido para asistir a las visitas programadas los fines de semana por razones laborales, la convivencia pudiera llevarse a cabo entre los abuelos paternos y el ni\u00f1o, en los mismos t\u00e9rminos.<\/p>\n

Adicionalmente, se le otorg\u00f3 la posibilidad de visitar a su hijo los d\u00edas que descansara durante la semana, \u00e9sto para buscar un mejor equilibrio entre la madre y el padre.<\/p>\n

En su resoluci\u00f3n, la mencionada Sala advirti\u00f3 que, a diferencia del demandado, la mujer fue madre cuando todav\u00eda era adolescente, lo que trajo como consecuencia un retraso en sus estudios obligatorios, as\u00ed como su regularidad en el mercado laboral.<\/p>\n

Se observ\u00f3 que, a ra\u00edz de la separaci\u00f3n familiar, ella se vio en la necesidad de trabajar en el sector informal, mientras estudiaba en fines de semana, lo que deb\u00eda equilibrar con su labor como madre cuidadora y con las tareas del hogar. Adem\u00e1s, se reconoci\u00f3 que el padre se encontraba en una situaci\u00f3n excepcional debido a trabajaba en un estado vecino, lo que le imped\u00eda participar en la vida del ni\u00f1o con la frecuencia deseada.<\/p>\n

Carga desigual afecta a madres<\/strong><\/h4>\n

En este contexto, se estim\u00f3 que, la falta de consideraci\u00f3n de estas circunstancias, profundizaba la carga desigual en la distribuci\u00f3n de responsabilidades parentales que impactaba negativamente no solo en el bienestar del ni\u00f1o involucrado, sino tambi\u00e9n en el plan de vida y en las posibilidades de desarrollo de la madre del menor de edad.<\/p>\n

Con esta sentencia, el TSJE reconoce el impacto diferencial del embarazo adolescente en los proyectos de vida de las mujeres, particularmente en el acceso a la educaci\u00f3n, al empleo y a ingresos dignos.<\/p>\n

Tambi\u00e9n visibiliza la situaci\u00f3n de desventaja estructural de este grupo vulnerable y estableci\u00f3 como criterio incorporar este an\u00e1lisis de la distribuci\u00f3n de las cargas y responsabilidades parentales en casos futuros, con el objetivo de evitar la emisi\u00f3n de resoluciones que puedan contribuir a perpetuar las brechas de oportunidad que enfrentan las madres adolescentes.<\/p>\n","protected":false},"excerpt":{"rendered":"
