{"id":79809,"date":"2022-01-21T19:53:54","date_gmt":"2022-01-22T01:53:54","guid":{"rendered":"https:\/\/reporteroshoy.mx\/noticias\/?p=79809"},"modified":"2022-01-21T19:53:54","modified_gmt":"2022-01-22T01:53:54","slug":"la-4t-da-carpetazo-a-denuncia-penal-contra-rolando-zapata","status":"publish","type":"post","link":"https:\/\/reporteroshoy.mx\/noticias\/la-4t-da-carpetazo-a-denuncia-penal-contra-rolando-zapata\/","title":{"rendered":"La 4T da \u2018carpetazo\u2019 a denuncia penal contra Rolando Zapata"},"content":{"rendered":"<p style=\"text-align: justify;\">Ciudad de M\u00e9xico, 21 de enero de 2022.- La Fiscal\u00eda General de la Rep\u00fablica (FGR) notific\u00f3 de un acuerdo en el que determina la facultad de abstenci\u00f3n de investigar la denuncia por la cancelaci\u00f3n del Proyecto de Prestaci\u00f3n de Servicios Hospital de Ticul presentada contra Rolando Zapata Bello y\/o quien resulte responsable, pues considera que el delito atribuible prescribi\u00f3 en diciembre de 2019.<\/p>\n<p style=\"text-align: justify;\">El delito identificado por la autoridad ministerial como aplicable al imputado es abuso de autoridad, en su hip\u00f3tesis \u201ccometido por el servidor p\u00fablico que indebidamente niegue a los particulares un servicio que tenga la obligaci\u00f3n de darles\u201d, previsto en el Art\u00edculo 215 fracci\u00f3n III del C\u00f3digo Penal Federal, sancionado con pena de uno a ocho a\u00f1os de prisi\u00f3n y de cincuenta hasta cien d\u00edas multa.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-79810\" src=\"https:\/\/reporteroshoy.mx\/noticias\/wp-content\/uploads\/2022\/01\/IVONNE-ORTEGA_RZB.jpg\" alt=\"\" width=\"650\" height=\"459\" \/><\/p>\n<p style=\"text-align: justify;\">Considera el Ministerio P\u00fablico Federal que dicho delito se consum\u00f3 en mayo de 2015, con la cancelaci\u00f3n del Proyecto, y de esa fecha a la actualidad no se practic\u00f3 ninguna diligencia para investigar ni, en consecuencia, sancionar el il\u00edcito, por lo cual se actualizar\u00eda la \u201cprescripci\u00f3n de la acci\u00f3n penal del delito en estudio\u201d.<\/p>\n<p style=\"text-align: justify;\">El equipo jur\u00eddico de Ivonne Ortega Pacheco, denunciante en el caso, hace notar que no es el \u00fanico delito imputado a Rolando Zapata Bello y\/o quien o quienes resulten responsables por la acci\u00f3n denunciada, y hay discrepancia sobre la catalogaci\u00f3n de la temporalidad del il\u00edcito, motivo por el cual se exploran las v\u00edas legales para hacer valer el precepto ya identificado, para que no quede impune.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>FGR se abstiene de investigar el caso del hospital de Ticul;
